The ‘Brussels II’ Regulations have a long history and provide the EU’s rules on jurisdiction, recognition and enforcement of matrimonial matters, matters of parental responsibility, and international child abduction. In 2016, the EU Commission published its Proposal for recasting what was then Council Regulation No 2201/2003 (‘Brussels II-bis’). There followed lengthy negotiations that resulted in the recast Council Regulation No 2019/1111 (‘Brussels II-ter’), which came into force in August 2022. Brussels II-ter has made substantial changes. Brussels II-ter is the key EU instrument for dealing with cross-border issues involving recognition of divorce, custody and access disputes over children, international abduction and the placement of children from one Member State to another.

About the Authors
Nigel Lowe KC (Hon), LLB, LLD, Barrister, is an Emeritus Professor of Law at Cardiff University, UK.
He is a well-known expert in international family law, particularly cross-border disputes concerning children, on which he has written extensively. His work is cited in courts and in academic literature around the world. Nigel was a member of the Expert Group assisting the EU Commission on the Recast of Brussels II-bis Regulation (2015), as well as the UK International Family Law Committee, and acts as a Sometime Consultant to the Permanent Bureau of the Hague Conference on Private International Law and the Council of Europe.
Costanza Honorati, Dr., is a Professor of European Union Law at the Milano–Bicocca University’s School of Law, where she also holds the position of Chair of EU Private International Law. She was a member of the Expert Group assisting the EU Commission on the Recast of the Brussels IIa Regulation (2015–2017) and the Chair of the Commission’s EJN Working Group on a Guide to the Maintenance Regulation (2019–2022). Costanza has written extensively in the field of European private international law, and in the last years mostly—but not exclusively—in family law matters. She is a Member of the Editorial Board of Rivista di diritto internazionale privato e processuale and Special Editor for PIL of “European Papers”.
Michael Hellner LLM, LLD, is a Professor in Private International Law at Stockholm University. He has represented the Swedish government in several negotiations for international instruments in the area of private international law in the EU and the Hague Conference for Private International Law. He has also been an expert or chair to several Swedish government committees and Hague Conference working groups on private international law. He is a member of the editorial board of the Journal of Private International Law, a member of the European Group of Private International Law, and is an Associate Fellow of the International Academy of Family Lawyers (IAFL).
