This book shows how the current reform in investment regulation is part of a broader attempt to transform the international economic order. Countries in the North and South are currently rethinking how economic order should be constituted in order to advance their national interests and preferred economic orientation. While some countries in the North seek to create alternative institutional spaces in order to promote neoliberal policies more effectively, some countries in the South are increasingly skeptical of this version of economic order and are experimenting with alternative versions of legal ordering that do not always sit well with mainstream versions promoted by the North. While we recognize that there are differences in approaches to the investment regimes proposed by countries in the South, we identify commonalities that could function as the founding pillars of an alternative economic order.

Sanchez Badin, Michelle Ratton
Michelle Ratton Sanchez Badin is a full time associate professor of International Law and Director of the Global Law Study Center, at São Paulo Law School of Getulio Vargas Foundation (FGV Direito SP), São Paulo, Brazil. She was one of the founders of the Society of International Economic Law (SIEL) and the current Director of the Latin American Network of International Economic Law (Rede LA-DEI).

Morosini, Fabio
Fabio Morosini is an associate professor at the Universidade Federal do Rio Grande do Sul School of Law, in Porto Alegre, Brazil, where he directs the Center for Law, Globalization and Development, and teaches and conducts research on international law, international trade, international investment, and methods in law. He is a research fellow at the National Council of Scientific and Technological Development (CNPq, Ministry of Science and Technology, Brazil), leading a research project on South-South trade and investment relations. He is a member of the American Society of International Law and the Society of International Economic Law, director of the International Law Association (Brazil branch), and a member of the executive council of the Latin American International Economic Law Network (RED-DEI).
